Keep CBD and Hemp Legal in IL

Thanks to everyone's help raising desperately needed awareness in Springfield. The problematic and unfinished HB4293 Amendments did not come up for vote in the House before the Illinois Spring Legislative Session adjourned at 5 a.m.
Although that prevents disastrous legislation from being enacted in the short term, it's very unfortunate that maneuvers by cannabis interest groups prevented much-needed regulation to help prevent THC products from getting into the hands of minors. More than ever, we will continue to push for meaningful discussion and actual negotiation so reasonable regulation of the hemp and cannabis industry is enacted for the benefit of Illinois. Cubbington's Cabinet is extremely alarmed that hastily written, inaccurate, and incomplete proposed legislation is nearing a final vote by Illinois State Representatives that will decimate the hemp industry while hurting our state's challenged economy.
Please call your Illinois State Representative to leave a brief message saying you oppose language in House Bill 4293 Amendments.
Although we support reasonable regulation of the hemp industry, this legislation would essentially a BAN all hemp-derived consumable products, including CBD and other non-intoxicating cannabinoids!
It would also replicate and amplify social equity failures in current cannabis regulation.

As many in our community are aware, Jennifer and the Cubbington’s team have been proactive advocates of thoughtful regulation and taxation in the hemp industry since we opened in 2020 with a particular focus on accuracy of labeling and full panel, third-party, final-product testing. Unfortunately, as we near the end of Springfield’s legislative session, a fast-tracked bill was introduced by misinformed politicians that would ban the sale of almost every item at Cubbington's, including all CBD products and our own 0% THC tinctures. The bill is extraordinarily restrictive and goes far beyond the bill sponsor’s talking points of saving kids from potentially dangerous products. It would literally cut off consumer access to hemp-derived cannabinoids outside of dispensaries (where the taxation/financial realities would not support the sale of most of the products Cubbington’s sells) and immediately destroy a conscientious business like ours.
While we do not have the resources to fight powerful interest groups through armies of lobbyists and manipulation of legislators and the media, we can utilize our democratic system and mobilize our community! If your Illinois legislator hears from you and learns just how bad this bill will be for consumers and small businesses, we might survive and continue our efforts toward reasonable legislation! Please help us in opposing HB4293 or any last-minute-introduced legislation that will destroy the hemp industry and hurt consumers. Make your voice heard!

HB4293 Fails to Protect Children:

In a recent JAMA study, 11% of teens admitted to using Delta-8 compared to 30% who admitted to using Delta-9 THC marijuana (Adolescent Δ8-THC and Marijuana Use in the US, JAMA, March 12, 2024). Contrary to the Sponsor's speaking points, this bill DOES NOTHING to protect kids from being poisoned by marijuana products sold at dispensaries.

During Senate debate on this bill, the Sponsor admitted that this bill FAILS to stop online delta-8 purchases or purchases made across state lines. This bill will allow children to get delta-8, and it will encourage a new illicit black market.

Bill fosters the War on Drugs 2.0. Even accidental violations come with extremely harsh penalties. Since most hemp now on the market would be reclassified as cannabis, thousands of law-abiding businesses would immediately be hit with $10,000/day fines for any violations, along with a loss of all licensure, seizures of property, and automatic violation of the Consumer Fraud Act. There is no off-ramp period to allow small businesses to comply by winding down their hemp product sales.

The bill Implements a complex and unreliable hemp licensing scheme. The process is based on the flawed cannabis licensing system that has overwhelmingly disenfranchised minority and low-income Illinoisians.
- Although the bill may not intend to do so, it contains technical mistakes and unscientific definitions that will immediately ban all non-intoxicating CBD products, including pet products and widely used cosmetic and wellness products. It will immediately criminalize businesses who sell those types of non-intoxicating CBD consumer goods. Flawed technical definitions ban basically all hemp products, including non-intoxicating CBD cosmetic, wellness, and pet products.

Impossible processing standards. The overly broad definition of “synthesis” covers all isomerization, and other chemical processes, (including natural processes and other processes which regularly occur in the food industry). This would effectively ban the current CBD processing industry.

Impossible manufacturing standards. By imposing the 0.3% limit on interim products, no extraction can go on in the State. Compliant hemp will naturally have its potency increase when the cannabinoids are extracted, even if they are in a small percentage.

Market killing standards. All products would have to be sized to have less than 0.5mg THC per serving/ 2mg THC per package. The effect would be that most hemp products currently sold, both THC and CBD products, would be illegal in Illinois. Even non-intoxicating CBD isolate would be banned.
